Subject: LTP - Announcing the New Easement Common Provisions Manual Survey Policy


 
Purpose.   To announce the publication of easement survey policy and provide an overview of the policy.   
 
Expiration Date.   September 30, 2022
 
Background.   Title 440 Conservation Program Manual (CPM), Part 527 Easement Common Provision, Subpart G, “Surveys,” was published on November 1, 2021. The policy applies to the following programs: Agricultural Conservation Easement Program – Wetland Reserve Easement (ACEP-WRE) component; Emergency Watershed Protection Program – Floodplain Easements (EWPP-FPE); Healthy Forests Reserve Program (HFRP); and all Farm Bill 2018 Regional Conservation Partnership Program (RCPP) U.S.-held easements, RCPP-HFRP, and RCPP-WRE easements. Subpart G, “Surveys,” provides guidance to States on current policy, standards, and requirements for easement boundary surveys and easement boundary reestablishment surveys along with resources such as checklists and forms. The 440-CPM, Part 527 Subpart G supersedes survey policy found in 440-CPM 528 Subpart M, “ACEP-WRE Enrollment and Acquisition,” 440-CPM 511 Subpart E, “Enrollment and Acquisition,” and Title 390 Project Development and Maintenance, Part 514 Subpart D, “Acquisition”.
 
Explanation.   The survey policy provided in Subpart G and associated exhibits applies to the above listed easement programs as of the publication date.

The survey policy covers:
•   Need and purposes for easement boundary surveys
•   Procurement and acceptance of easement boundary surveys
•   Processes to request easement boundary reestablishment surveys
•   Procurement and acceptance of easement boundary reestablishment surveys

EPD approval must be obtained prior to requesting new task orders for a reestablishment survey. States may request this EPD approval by uploading the required information in Program Activity Management Solution (PAMS).

Easement Programs Division (EPD) staff will provide an overview of the new policy to States during an upcoming EPD Monthly Net Conference.
