Purpose.  To announce the publication of NI 300-308 “Agricultural Conservation Easement Program - Agricultural Land Easement (ACEP-ALE) Buy-Protect-Sell Transactions” and updates to NI 300-306. Together these National Instructions provide States with guidance, procedures, exhibits, and forms needed to the implement ACEP-ALE buy-protect-sell transactions.      
 
Expiration Date.  September 30, 2021   
 
Background.  The 2018 Farm Bill created a new transaction type under the Agricultural Land Easement component of the Agricultural Conservation Easement Program (ACEP-ALE) authorizing the use of buy-protect-sell transactions. Following publication of the ACEP final rule at 7 CFR Part 1468, the policy needed to implement buy-protect-sell transactions was released.          
 

Explanation.  NI 300-308 and updates to NI 300-306, Attachments A and G, were published to eDirectives on April 27, 2021, and must be used to implement all ACEP-ALE buy-protect-sell transactions.

As an additional information resource, EPD has posted a series of recorded presentations for NRCS staff that provide information on the administration of ACEP-ALE buy-protect-sell transactions at an introductory, overview, and in-depth, topic-specific level. These recordings are available in the “Mini Trainings” section of the EPD SharePoint site at: ACEP-ALE Buy-Protect-Sell Info Modules. These modules are a learning aid as NRCS staff familiarize themselves with the regulations, policy, and procedures under which this new transaction type will be implemented.

EPD staff will also provide a presentation on ACEP-ALE buy-protect-sell transactions specifically geared to the external audience of interested eligible entities. This information will first be presented live during the Land Trust Alliance Webinar Series on Tuesday, June 8, 2021, at 2:00 pm EDT, and the recorded webinar will be subsequently available for viewing. Instructions to invite interested eligible entities to attend the webinar and to access the recording will be forthcoming to NRCS staff.
