Subject: LTP – Update to National Instruction (NI) 300-306 Agricultural Conservation Easement Program Agricultural Land Easement (ACEP-ALE) Program Agreements and Parcel Contracts  


 
Purpose. To announce a published update to Exhibits A and G of NI 300-306, “Agricultural Conservation Easement Program Agricultural Land Easement (ACEP-ALE) Program Agreements and Parcel Contracts” and inform States and Easement Acquisition Branch (EAB) to utilize new exhibits.     
 
Expiration Date. September 30, 2021   
 
Background. NI 300-306, “Agricultural Conservation Easement Program Agricultural Land Easement (ACEP-ALE) Program Agreements and Parcel Contracts” was updated and published on April 27, 2021, to address the ACEP final rule.         
 

Explanation. NI 300-306 contains policy regarding the use of program agreements and parcel contracts to simplify, streamline, and improve ACEP-ALE program delivery. It provides associated forms and agreements, including Exhibit A ACEP-ALE Program Agreement and Exhibit G Form NRCS-CPA-1268, “Conservation Activity Approval and Payment Application for Acquisition of Easements,” which were both updated and published on April 27, 2021. States are instructed to utilize the updated Exhibits A and G as published in NI 300-306. As of April 27, 2021, States may no longer utilize the previously published forms. States were provided training on April 27, 2021, during the EPD Monthly net conference on the availability of the published forms.

The ACEP-ALE program agreement found in Exhibit A, provides the framework including eligibility, identification of legal entities, and guidelines required by program participants. Form NRCS-CPA-1268 is required documentation that must be completed to:

    (1) establish distribution of the payment amount owed to each eligible entity.
    (2) determine the total amount owed to each eligible entity.
    (3) identify how the funds owed will be distributed.
