NB 300-19-15 LTP – Extension of FY 2014 CSP Contracts

Subject: LTP - Extension of FY 2014 CSP Contracts

Purpose.  To provide State conservationists (STCs) with guidance to extend existing Conservation Stewardship Program (CSP) contracts obligated in fiscal year (FY) 2014 to allow for possible renewal of those contracts in FY 2020.    
 
Expiration Date.   September 30, 2019   
 
Background.  The Agricultural Improvement Act of 2018 (2018 Act), signed into law by the President on December 20, 2018, authorizes NRCS to offer one renewal opportunity to existing CSP contracts during the final year of the contract.  Because of uncertainty prior to enactment of the 2018 Act, NRCS previously extended FY 2014 CSP contracts up to the 5-year statutory limit for participants who applied for contract renewal in FY 2018.  The 2018 Act subsequently repealed the renewal authority provided under the 2014 Act, but it also provided for NRCS to extend contracts that expire on or before December 31, 2019, for 1 additional year so that these contracts may be eligible for renewal under the new authority.    
 
Explanation. While the 2018 Act authorizes NRCS to offer participants an opportunity to renew their existing CSP contracts during the final year of the contract, NRCS is currently developing the new requirements for renewals based on changes made in the 2018 Act.  This bulletin provides States with guidance and procedures to extend CSP contracts obligated in FY 2014 for 1 additional year where NRCS previously extended the contract based on participants applying for renewal under the previous authority.

 

Participant Notification

  • No later than April 8, 2019, States must send the attached “Contract Extension Notification Letter” (attachment A) to all participants who have an active CSP 2019-1-Renewal application.

  • Upload a copy of the notification letter to DMS.

  • Renewal applications in the 2019-1-Renewal signup with a status of pending, eligible, or preapproved will be canceled by ProTracts support after June 1, 2019.

     

    Modifications to Extend the FY 2014 CSP Contracts

  • ProTracts support will script a modification to extend all FY 2014 CSP contracts that have not yet expired in the March ProTracts build.  This modification will copy all contract items planned in the fifth year to the sixth year of the contract and set the expiration date to 6 years after the contract start date.

  • States are reminded to complete all existing modifications of these contracts prior to March 25, 2019, or the existing modification will be cancelled by the script.

  • Field offices may use the “Contract modifications in Progress (not yet submitted for approval)” in the “Manage Contracts” screen to identify contracts that were scripted to extend for an additional year.  The mod type will be “Other.”

  • Prior to submitting the modification for approval, the field office will follow existing policy in 440-CPM-508-K-508.101.

  • States must approve the modifications for all eligible participants who have requested extension no later than May 31, 2019.

  • States must cancel modifications for participants who have not requested contract extension or declined to sign the 1156 for extension no later than May 31, 2019.

     

    Changes to the Agricultural Operation

  • Access to the CMT to reduce contract acres will not be allowed during the scripted modification.  If the participant has lost control of acres in the contract, the modification type of “Inventory Adjustment” should be approved before March 25, 2019, or in a separate modification after the scripted modification is approved.

  • Access to the CMT to evaluate activity substitution, activity deletion, or to complete a partial land transfer will not be possible following the modification to extend the contract.  Contract modifications of these types should not be attempted by field users following extension, as they will require ProTracts support.

     

    Obligations and Payments

  • NRCS will obligate funds for the sixth year of activities at the rate and amount in effect for the fifth year of the contract. 

  • Participants will be subject to the statutory payment limits of the Agricultural Act of 2014 as outlined in the contract appendix.

  • Participants who are at or near the payment limitation may still extend their contracts for a sixth year, but their payments will be reduced accordingly.

Participants may be eligible to receive payment for planned activities adopted during FY 2019 after October 1, 2019.
